Criminal Record Checks
This position will be exempt from the provisions of Section 4 (2) of the Rehabilitation of Offenders Act 1974. Therefore, applicants are not entitled to withhold information about any convictions or cautions which for other purposes are ‘spent’ under the provision of the Act, unless the conviction or caution is considered “protected” (as defined by the amendments to the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (2013 and 2020)). If a conviction or caution is protected that means that they do not need to be disclosed to employers, and if they are disclosed, employers cannot take them into account.
Guidance about whether a conviction or caution should be disclosed can be found on the Ministry of Justice website.
The fact that a pending charge, or a conviction or caution has been recorded against you will not necessarily debar you from consideration for this role but any failure to disclose any such information as required may result in dismissal or disciplinary action.
